1. About these Terms

These Terms of Service ("Terms") govern your use of BattleReady and any related services (the "Service") provided by Red Beech Software (ABN 29 271 992 140), a sole trader business based in Australia ("Red Beech", "we", "us", "our").

By creating an account or using the Service, you agree to these Terms and to our Privacy Policy. If you don't agree, please don't use the Service.

2. Eligibility

You must be at least 13 years old to use the Service. If you are between 13 and the age of majority in your jurisdiction (18 in Australia), you confirm that a parent or guardian has reviewed and consented to these Terms on your behalf.

By using the Service, you confirm you have the legal capacity to enter into these Terms.

3. Your account

To use most features of the Service, you'll need to create an account. You agree to:

  • Provide accurate information when you sign up
  • Keep your password (and any other authentication credentials) confidential
  • Be responsible for all activity that occurs through your account
  • Notify us promptly if you suspect any unauthorised access

Sign-in is managed through Firebase Authentication. We may suspend or close accounts that we reasonably believe are being used in breach of these Terms.

4. The Service

The Service is a hobby tracking tool for miniature and model painters. It lets you record paint inventory, project details, techniques, recipes, and progress photos, and (where you choose to) share specific items with other users.

Features may evolve over time. We may add, change, or remove features at our discretion, and we will give reasonable notice for changes that materially reduce how you can use the Service. The Service is operated from Australia and accessible globally; you are responsible for complying with the laws of your own jurisdiction.

5. Pricing and payment

5.1 Free and paid tiers

The Service offers a free tier and a paid tier. The paid tier is unlocked through a single one-time purchase, which grants ongoing access to the paid features for the lifetime of the Service (see 5.3). Available tiers, features, and the current price are set out in the Service. Prices may change with reasonable advance notice; any price change applies only to purchases made after the change takes effect and does not affect access already unlocked.

5.2 Payment processing

Payments are processed by:

  • Stripe, Inc. for purchases made on our website
  • Apple Inc. for in-app purchases made through the iOS app
  • Google LLC for in-app purchases made through the Android app

Each provider has its own terms and refund policies. By purchasing through them you also agree to those terms.

5.3 One-time purchase, no recurring billing

Paid access is unlocked through a single one-time purchase. There are no subscriptions, no recurring charges, and no auto-renewals. Once you have purchased the paid tier, you retain access to the paid features for as long as we continue to operate the Service (referred to in these Terms as "lifetime access"). If we discontinue the Service, we will give reasonable advance notice as described in section 9.2.

5.4 Refunds

Web purchases (Stripe). If you change your mind, you can request a full refund within 14 days of purchase by emailing support@getbattleready.app. No reason required. Refunds requested after 14 days are at our discretion.

iOS in-app purchases. Refunds for purchases made through the App Store are handled by Apple under Apple's refund policy. We are unable to issue refunds for App Store purchases directly.

Android in-app purchases. Refunds for purchases made through Google Play are handled by Google under Google's refund policy. We are unable to issue refunds for Google Play purchases directly.

Nothing in this section limits any rights you have under the Australian Consumer Law that cannot lawfully be excluded, including any right to a refund where consumer guarantees apply (see section 10).

5.5 Taxes and currency

Prices are quoted and charged in US Dollars (USD). Red Beech Software is not registered for Australian GST, so we do not add GST or other taxes to your purchase. Your bank or card issuer may apply a foreign currency conversion fee or exchange-rate margin; those charges are between you and them.

6. Your content

6.1 You own your content

You retain ownership of the paint records, project data, photos, recipes, notes, and other content you create or upload through the Service ("Your Content").

6.2 Licence to us

To operate the Service, you grant us a non-exclusive, royalty-free, worldwide licence to host, store, copy, transmit, and display Your Content solely for the purpose of providing the Service to you and, where you have chosen to share specific items, to the users you've shared them with.

This licence:

  • Lasts only as long as we hold Your Content (which is until you delete it or close your account, plus the short deletion window set out in our Privacy Policy)
  • Does not permit us to use Your Content for marketing, advertising, AI or machine learning training, or any purpose beyond running the Service
  • Does not transfer ownership to us
  • Is non-sublicensable, except to service providers (such as our cloud hosts) strictly to the extent needed for them to provide their services to us

6.3 You are responsible for what you upload

By uploading content, you confirm that:

  • You own it or have the necessary rights to upload it
  • It doesn't infringe anyone else's copyright, trademark, or other rights
  • It doesn't break any applicable laws or these Terms

6.4 Shared content and community standards

When you choose to share an item publicly within the Service — for example, publishing a paint recipe — you grant other users a limited right to view that item within the Service. You can unshare items at any time, but copies that other users have already saved or referenced may persist.

You must not share content that is:

  • Unlawful, infringing, defamatory, or violates anyone's privacy
  • Hateful, harassing, threatening, or sexually explicit
  • Designed to harm or deceive others (including malware, phishing, spam, or impersonation)

We may remove shared content that breaches these Terms, with or without notice depending on the severity.

7. Acceptable use

You agree not to:

  • Reverse engineer, decompile, or attempt to extract the source code of the Service, except to the extent that law expressly permits
  • Scrape, harvest, or systematically extract data from the Service
  • Use the Service to send spam or unsolicited communications
  • Interfere with or disrupt the Service or its underlying infrastructure
  • Attempt to gain unauthorised access to other accounts, our systems, or related networks
  • Use the Service for any unlawful purpose
  • Resell or commercially redistribute the Service without our written permission
  • Use automated tools or bots in a way that imposes an unreasonable load on the Service

8. Our intellectual property

The Service itself — including its software, design, layout, logos, and any content we create — is owned by Red Beech Software or licensed to us. These Terms don't transfer any of those rights to you. We grant you a personal, non-transferable, revocable licence to use the Service in accordance with these Terms.

9. Termination

9.1 By you

You can stop using the Service and close your account at any time through your in-app account settings or by emailing us. Your data will be handled as described in our Privacy Policy.

If you have previously purchased the paid tier and later create a new account, contact support@getbattleready.app and we will restore your paid access where we can reasonably match your new account to your prior purchase (for example, using the same email address or payment method). This does not apply where we previously closed your account for breach of these Terms (see 9.2).

9.2 By us

We may suspend or close your account if:

  • You materially breach these Terms
  • We are required to by law or a regulator
  • We discontinue the Service (in which case we will give reasonable advance notice)

For non-urgent breaches, we will generally let you know what the issue is and give you a reasonable chance to fix it before closing your account. For serious breaches — including infringing content, abuse of other users, or threats to security — we may suspend or close your account immediately.

9.3 Effect of termination

When your account is closed, your access to the Service ends. Your data is handled per our Privacy Policy. Any provisions that should reasonably survive termination — including content licences for material you have shared publicly, limitations of liability, and indemnities — will continue to apply.

10. Australian Consumer Law and disclaimers

We provide the Service with reasonable care and skill, but we cannot promise it will be uninterrupted, error-free, or perfectly accurate. The Service is provided on an "as is" and "as available" basis, subject to the rights set out below.

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. For major failures with the service, you are entitled:

  • to cancel your service contract with us; and
  • to a refund for the unused portion, or to compensation for its reduced value.

You are also entitled to be compensated for any other reasonably foreseeable loss or damage. If the failure does not amount to a major failure, you are entitled to have problems with the service rectified in a reasonable time and, if this is not done, to cancel your contract and obtain a refund for the unused portion of the contract.

To the extent permitted by law, and subject to the rights set out above and other non-excludable rights you have under the Australian Consumer Law, we exclude all other warranties, conditions, and guarantees, whether express or implied.

11. Limitation of liability

To the extent permitted by law:

  • We are not liable for any indirect, incidental, consequential, special, or punitive damages, including loss of profits, loss of data, or loss of goodwill, even if we were advised of the possibility of such damages.
  • Our total aggregate liability for any claims arising out of or relating to the Service in any 12-month period is limited to the greater of (a) the amount you have paid us in the 12 months before the claim arose, or (b) USD $50.

Nothing in these Terms excludes, restricts, or modifies any rights or remedies you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.

12. Indemnity

You agree to indemnify Red Beech Software against any losses, costs, or claims (including reasonable legal fees) arising out of:

  • Content you upload, share, or otherwise make available through the Service
  • Your breach of these Terms
  • Your misuse of the Service in violation of these Terms or any applicable law

This indemnity does not apply to losses caused by our own breach of these Terms, our negligence, or anything we are legally responsible for.

13. Third-party services

The Service is built on third-party platforms — including Vercel, Firebase (Google), Stripe, Apple, Google Play, and Sentry. Your use of the Service through those platforms may also be subject to their respective terms. If you use the iOS app, Apple's standard end user licence agreement for licensed applications may apply in addition to these Terms.

14. Changes to these Terms

We may update these Terms from time to time. For material changes, we will notify you by email and/or through a prominent notice in the Service at least 14 days before they take effect.

If you don't agree to the updated Terms, you can close your account before the changes take effect. Continuing to use the Service after the effective date means you accept the updated Terms.

15. Governing law and disputes

These Terms are governed by the laws of New South Wales, Australia. The courts of New South Wales have exclusive jurisdiction over any disputes arising out of or relating to these Terms or the Service, except that this section does not prevent you from bringing a claim in your local jurisdiction where you have a right to do so under consumer protection laws that apply to you.

Before starting any formal dispute, please contact us first so we can try to resolve the issue.

16. General

  • Severability: If any part of these Terms is found to be unenforceable, the rest remains in effect.
  • No waiver: If we don't enforce a right, that doesn't mean we waive it.
  • Assignment: You can't transfer your rights under these Terms without our consent. We may transfer our rights (for example, if the business is sold or restructured), with notice to you.
  • Entire agreement: These Terms, together with our Privacy Policy, are the entire agreement between you and us regarding the Service and replace any earlier understandings.
